In these Terms, "Helvy", "we", "us" and "our" refer to NOLOW CODE - Apps & Solutions, the operator of the Helvy mobile application and of the website helvy.jobs (together, the "Service").

By downloading, installing, or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you and NOLOW CODE - Apps & Solutions. When you create an account you confirm that you have read, understood and accept these Terms and our Privacy Policy.

Each version of these Terms carries a version identifier, shown at the top of this page. We record which version you accepted, and when.

Helvy is a job search and documentation application for people looking for work in Switzerland, in particular those registered with a regional employment office (RAV, ORP or URC). The Service lets you discover job offers, import an offer you found elsewhere, generate application documents, record every job search step you take, and produce a monthly record of your job search efforts.

To create an account and use Helvy, you must:

• Be at least 16 years of age
• If you are under 18: have the consent of your parent or legal representative both to use the Service and to enter into the subscription (Art. 19 para. 1 of the Swiss Civil Code)
• Be legally permitted to work in Switzerland, or be in the process of obtaining a work permit
• Provide accurate and truthful information during registration and onboarding
• Have a valid email address

Helvy is designed primarily for individuals registered with a Swiss regional employment office, but is not restricted to them. Using the Service does not itself register you with any authority.

To access the Service you must create an account with a valid email address and a password, or use Google Sign-In. You are responsible for:

• Keeping your credentials confidential
• All activity that occurs under your account
• Telling us immediately about any unauthorised access, at support@helvy.jobs
• Keeping the information in your profile accurate and up to date

One account per person. Accounts are personal and non-transferable. We may suspend or terminate accounts we reasonably believe are shared or used fraudulently.

Google Sign-In

If you register with Google Sign-In, your use of that method is also subject to Google's own terms and privacy policy. We receive only the basic profile information needed to create your Helvy account.

Access to Helvy requires a paid subscription.

Billing

All payments are processed by the Apple App Store or Google Play. Prices are in Swiss francs and include applicable taxes. Helvy never receives or stores your payment card details.

Auto-renewal and cancellation

Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. You manage and cancel your subscription in your Apple App Store or Google Play account settings, not in the Helvy app.

Refunds

• Apple: request a refund at reportaproblem.apple.com
• Google Play: request a refund through Google Play support

Price changes

We may change subscription prices. You will be notified at least 30 days before a price change takes effect, and you may cancel before it applies. Continuing to use the Service after the change takes effect means you accept the new price.

What Helvy produces

Depending on your plan, Helvy can generate a CV, a cover letter, and a monthly record of your job search efforts in the format of the official federal form for proof of job search efforts (form 716.007). These documents are generated from the information you provide and from the job offers you select or import.

Recording your job search

You can record a job search step in Helvy whether or not the offer came from Helvy. This includes an offer you paste in, an offer captured from a photograph or screenshot, a spontaneous application, a telephone call to an employer, and a visit in person. You are responsible for the accuracy of every entry.

Signature (Pro)

If you have a Pro plan, you may draw your signature in the app so that Helvy can place it on documents you generate, including cover letters and your monthly job search record.

• Providing a signature is optional. All documents can be generated without one.
• Your signature is applied only to documents you yourself choose to generate.
• You remain solely responsible for the content of any signed document, and for reviewing it before you send it.
• You can delete your stored signature at any time in Settings. Documents generated before deletion may still contain it; you can delete those documents individually.
• We keep a record of when each document was generated and signed, so that the document can be traced if it is ever questioned.

Sending is always your action

Helvy never sends a document to an employer or to an authority on your behalf. You download or share every document yourself, and you decide what to send and to whom.

You agree to use Helvy only for your own personal job search. You must not:

• Record fictitious, fabricated or fraudulent job search steps or applications
• Submit false information to an authority using documents generated with Helvy
• Apply your signature, or ask Helvy to apply it, to a document whose content you have not reviewed
• Attempt to reverse-engineer, decompile or extract the source code of the app
• Use the Service for any commercial purpose other than your own job search
• Share your account credentials
• Use bots, scrapers or automated tools against the Service
• Attempt to access data belonging to other users
• Upload malicious files or unlawful content
• Breach any applicable law

All content, features, design, code, algorithms and trademarks within the Service are owned by or licensed to NOLOW CODE - Apps & Solutions and are protected by Swiss, French and international intellectual property law.

You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own job search. This licence does not allow you to:

• Copy, reproduce or distribute any part of the Service
• Create derivative works based on the Service
• Use the Helvy name, logo or brand assets without prior written consent
• Sublicense or resell access to the Service

The documents you generate with Helvy, such as your CV, your cover letters and your job search record, are yours to use freely.

You keep full ownership of everything you create or upload in Helvy: your profile data, your recorded job search steps, your notes, your CV and your signature.

You grant us a limited, non-exclusive licence to store and process your content for the sole purpose of providing the Service to you. We use it for nothing else.

CV upload

If you upload a CV, you confirm that you are its author or have the right to upload it, that it contains no third-party confidential information, and that you agree to it being processed to extract profile data as described in our Privacy Policy.

You can delete your CV at any time in Settings.

Accuracy of what you record

You are solely responsible for the accuracy of the job search steps you record. We do not verify whether an application was actually sent, whether a call actually took place, or whether an offer actually existed. Any document Helvy produces reflects exactly what you have recorded.

No employment guarantee

Helvy does not guarantee employment, interviews, offers or any particular outcome. Job listings shown in the app come from third-party sources and may be inaccurate, out of date or no longer available. We are not responsible for their quality, accuracy or availability.

Match scores and generated text

Match scores and generated documents are produced with automated assistance and are indicative only. They are based on the information you provide. You must read every generated document before you use it, and correct anything that is wrong. We do not guarantee the accuracy of a match score or of generated text.

Service availability

We aim for a reliable service but do not guarantee uninterrupted access. The Service may be unavailable during maintenance or for reasons beyond our control.

Limitation of liability

To the maximum extent permitted by law, Helvy is not liable for indirect, incidental, special or consequential damages, including loss of employment opportunity, loss of income, or any decision taken by an authority in relation to your unemployment benefits.

Our total liability for any claim arising from these Terms or from your use of the Service shall not exceed the total amount you paid for the Service in the 12 months preceding the claim.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for intentional wrongdoing or gross negligence.

The monthly quota shown in Helvy is a guideline based on publicly available information. Your actual requirement is set individually by your advisor and may differ. Always follow your advisor's instructions.

The monthly job search record produced by Helvy is a convenience. It remains your responsibility to:

• Check that the format is accepted by your own office
• Ensure every recorded step is genuine and accurately described
• Submit your record within the deadline set by your office, normally by the 5th of the following month
• Spread your job search efforts through the month, as required
• Comply with every condition attached to your benefit entitlement

Helvy accepts no responsibility for any decision taken by an unemployment authority regarding your benefits, whether or not that decision relates to a document produced with the app.

By you

You can delete your account at any time in Settings. Deletion is permanent and your data is deleted as described in our Privacy Policy. Deleting your account does not by itself cancel your subscription: you must also cancel it in your Apple App Store or Google Play settings, otherwise it will continue to renew.

By us

We may suspend or terminate your account without notice if you breach these Terms, if we reasonably believe your use is fraudulent or harmful, or if we are required to by law or by a competent authority.

Effect of termination

Your right to use the Service ends immediately. As set out in section 6, no refund is issued by us in any case; any refund request must be made to Apple or Google.

Sections 9, 10, 11, 12 and 14 survive termination.

These Terms are governed by Swiss law.

Any dispute arising from these Terms or from your use of the Service shall be subject to the jurisdiction of the Swiss courts.

Before starting any formal proceedings, please contact us at legal@helvy.jobs. We will make a good-faith effort to resolve any complaint within 30 days.

We may update these Terms. When we make a material change we will notify you by email and in the app at least 14 days before it takes effect, and the version identifier at the top of this page will change. The current version is always available at helvy.jobs/terms-of-service/.

If you do not accept the updated Terms, you can cancel your subscription and delete your account before the effective date. Continuing to use the Service after that date means you accept the new version.
